Fourth Railway Package (Almost) Adopted journal article

In May 2016, a regulation and two directives constituting the “Technical Pillar” of the Fourth Railway Package were finally adopted and published in the Official Journal. At the end of April, a provisional interinstitutional agreement on the “Market Pillar” was reached as well, and the legislative measures contained therein may be expected to be adopted by the end of this year. In this article, we will summarise the ambitions of 2013, when the Fourth Railway Package was first unveiled, and compare it with the actual form which was, or is to be, adopted.

The Czech Parliament has adopted an extensive amendment of the Energy Act (“Amendment”) and other energy-related legislation, which will enter into force on 1 January 2016. The Amendment concerns the implementation of the relevant EU law, the institutional setting of the regulatory authority and certain adaptations to the new Civil Code, as well as numerous other changes inspired by hitherto practice.

Annotation of the Judgment of the Supreme Administrative Court of 20 December 2013 concerning export prohibitions in coal distribution

A recent judgement of the Supreme Administrative Court of the Czech Republic limited the extent to which a legal successor is liable for unlawful conduct of its predecessor; even if the succession took place after the Czech Republic’s accession to the EU, the liability cannot stretch before that date.
