Annotation on the Judgment of the Spanish Supreme Court of 27 November 2012 annulling the allocation of a digital multiplex to television operators, its scope and enforcement alternatives

This case note determines the possible consequences of the enforcement of the Supreme Court judgment of 27 November 2012 (“Judgment dated 27 November”), which annuls the Council of Ministers’ Resolution of 16 July 2010 (“CMR”) and the risks that such enforcement may pose in relation to the foreseen operation.
