Critical Assessment of the Measures Proposed by the European Commission Related to Authorisation, Spectrum Assignment and Net Neutrality

The European Commission presented a draft Regulation which aims to create optimal conditions for greater investment in the interest of European consumers and to the overall European economy by simplifying the authorisation regime, coordinating spectrum assignments, standardising wholesale access products, ensuring an open internet, reducing roaming charges and tightening consumer protection. This paper provides a critical assessment of three major issues of the proposed Regulation, namely the simplified authorisation system, the harmonised rules and schedule for spectrum assignment, and the rules related to the openness of the Internet by arguing that some of the tools proposed are not necessarily adequate and might contradict even to the declared goals of the Commission.
