The General Court’s Judgment in the Greek Lignite Case: Setting the Commission’s Limits for Finding an Infringement under Articles 106/102 TFEU?
On 20 September 2012, the General Court of the EU (“Court”) annulled a decision by the European Commission (“Commission”),1 which had found that Greece violated EU rules by preserving special (quasi exclusive) access rights for the mining and exploitation of lignite in favour of the State-owned electricity incumbent, Dimosia Epicheirisi Ilektrismou AE (“DEI”).
